Le Conseil d'Etat a-t-il donné un avis favorable ou défavorable au fichier EDVIGE ?
Comme le soulignait un commentateur sur la note précédente, on peut saluer la qualité de l'interview croisée proposée sur le site TF1.fr, entre d'une part le Gérard Gachet, porte-parole du ministère de l'Intérieur et, d'autre part, mon collègue Jean-Pierre Dubois, président de la Ligue des droits de l'Homme.
En ce qui concerne l'avis donné par le Conseil d'Etat au gouvernement, avant l'édiction du décret, les deux intervenants tiennent des propos étonnamment contradictoires.
Le porte-parole du Ministère de l'intérieur s'exprime en ces termes : « Nous avons l'habitude de voir certaines personnes s'élever dès qu'il s'agit de donner à la police ou à la justice les moyens de faire leur travail. Ces gens ont déposé des recours devant le Conseil d'Etat. Nous attendons son jugement avec la plus grande sérénité puisque nous avons tenu compte d'une partie des observations de la CNIL et, surtout, le décret qui a créé Edvige a été totalement conforme aux observations, aux demandes et aux suggestions du Conseil d'Etat.
(je ne dirai rien sur la mise en cause des personnes qui forment des recours, car ce n'est pas le sujet, mais ce genre de propos, tenus « au passage », me paraît révélateur de la culture de certains fonctionnaires).
Et Jean-Pierre Dubois de répondre : « ce que dit le gouvernement est faux. Selon mes informations, le Conseil d'Etat a émis un avis extrêmement défavorable. Je mets au défi le gouvernement de publier cet avis. Il est le seul à en avoir le droit. Et quand bien même l'avis du Conseil d'Etat serait favorable, cela ne veut rien dire par rapport aux recours que nous avons déposé... ».
Je ne dirai rien non plus sur la fin de la citation, les débats sur la double fonction du Conseil d'État, nous mèneraient évidemment trop loin.
Mais il reste une question centrale : cet avis du Conseil d'Etat, est-il favorable ou défavorable, au moins partiellement.
Il serait effectivement intéressant, comme le dit Jean-Pierre Dubois, que le gouvernement décide de sa déconfidentialisation, de manière à ce que cette expertise juridique menée par le Conseil d'Etat éclaire le débat public intense qui est entrain d'méerger.

Enfin, Gérard Gachet estime que «le communiqué de la Cnil est inexact» sur certains points; il minimise également le rôle de l'avis de l'organisme sur les modifications apportées au projet de décret. Le porte-parole de Michèle Alliot-Marie insiste sur le fait que c'est essentiellement l'avis du Conseil d'État qui a conduit la place Beauvau à apporter des modifications. Têtu regrette que l'avis du Conseil d'État n'ait pas été alors rendu public et invite le gouvernement à le faire.

Certes mais cela peut être pris au sens générique, un jugement rendu au travers d'un arrêt par le juge adminitratif suprême et non par un arrêteur ou autre néologisme du genre.
Mais ceci dit je suis consterné comme vous par cette inculture démocratique dans la haute fonction publique.

Dès que le président de la République a su que Frédéric Rolin a appelé à signer la pétition contre Edvige, il a pris la décision de faire machine arrière... :)

La mise en cause par Gachet des personnes qui exercent des recours n'est pas tant révélatrice de la culture de certains fonctionnaires que d'une mentalité d'extrême-droite.
Gérard Gachet était auparavant journaliste à Valeurs Actuelles et a milité au Parti des forces nouvelles (PFN), un ancien parti d'extrême-droite.
Je suppose qu'il est un fervent défenseur de la doctrine du déterminisme criminel. Et peut-être est-il un ami de Christian de Bongain, dit Xavier Raufer, ancien militant du groupuscule Occident et aujourd'hui enseignant.... à l'Institut de Criminologie.

Quand on se croit au-dessus du lot parce que l'on sait (mon dieu quelle culture) que le Conseil rend des arrêts, on essaye au moins d'éviter les fautes d'orthographe !!

Je partage volontiers l'avis général. Je me demande si la difficulté ne découle pas, au fond, de ce que les pouvoirs publics sont à la fois en situation d'agir et de réglementer, et cela n'est pas sain. Il est assez probable que la rédaction du décret ait été confiée pour l'essentiel aux services qui seront chargés d'exploiter le fichier et de l'utiliser. Pourquoi, dès lors, ne se donneraient-ils toutes les marges de manoeuvre nécessaires à cet effet (fichons tout le monde ça peut toujours servir au cas où) ? On rejoint en définitive cette affirmation de Montesquieu selon laquelle toute personne à qui un pouvoir est donné à tendance à en abuser... Moi ce qui m'étonne c'est qu'un décret suffise à créer ce genre de fichiers. Si une procédure législative avait été utilisée, il y aurait eu un débat public et démocratique.

Hier, le 19 septembre, une nouvelle mouture "allégée" du décret a été transmise à la CNIL.
Sauf erreur, l'avis du Conseil d'Etat sur la première mouture n'a toujours pas été rendu public.
Cher Professeur, ne pensez-vous pas, pour favoriser la transparence du fonctionnement démocratique et le respect du travail du conseil d'Etat, que cet avis devrait être rendu public, de toutes manières?
