Si vous habitiez en Chine, vous ne pourriez pas lire ce blog...
Alors que Serge Slama me reproche, dans un récent commentaire, une dérive droitière (je serais plus sensible à l’équité formelle du contentieux administratif qu’à l’équité véritable), je tiens à faire part d’un titre de gloire qui balaye toutes ces arguties : mon blog est interdit d’accès depuis la Chine.
Je tiens l’information d’un site de français vivant en Chine, qui ont cherché des astuces pour y accèder, via des logiciels spécialisés dans le contournement des mesures de blocages chinoises.
Et bien, je l’avoue, j’en suis très fier !
Restent les questions du comment et du pourquoi.
S’agissant du « comment », je ne connais pas le mode de fonctionnement de ces systèmes de blocages, mais de fait, une requête faite sur « yahoo chine » sur « Frédéric Rolin » n’aboutit pas, sauf à des commentaires ou à des citations sur d’autres blogs juridiques (journal d’un avocat, lieu commun…).
S’agissant du « pourquoi », je ne sais pas ce qui, dans mes doux écrits, a pu susciter l’ire des censeurs électroniques. Je n’imagine pas que ce soit la promotion de liberté contractuelle ni les contestations du Code des Marchés Publics. Peut-être quelques notes sur l’état d’urgence, encore que je ne crois pas avoir fait allusion à des situations internationales. Où bien l’abus d’usage du mot « démocratie » ? je suppute, je suppute…
Si certains de mes estimés lecteurs peuvent m'apporter des précisions sur l'importance quantitative de ces blocages et sur les modalités de mise en oeuvre, je serais très intéressé.

Quoi ! la notoriété de Frédéric Rolin n'a pas encore franchi la muraille de Chine? Il ne savent pas ce qu'ils perdent ces Chinois!!

Sur la "dérive droitière" de notre hôte, mon commentaire était du second degré.
Néanmoins je ne comprends pas comment on peut davantage s'attacher à l'équité formelle qu'à la possibilité réelle pour tous les administrés d'accéder au droit et à la justice. L'un ne va pas sans l'autre à mon sens.
A quoi sert d'avoir un procès administratif qui serait parfaitement équitable, avec un commissaire du gouvernement absent ou taiseux en délibéré et se "déportant" à l'envie, si en parallèle seuls 15 ou 20% des administrés peuvent réellement accéder à cette justice?
mais ça doit être mon côté "deuxième gauche"...

Bonjour Monsier Rollin,je m'appele Cyril ,je suis étudiant en 2ème année de Droit a Paris 1.
Actuellement,je travaille sur le droit administratif pour en comprendre le fonctionnement,les nuances, mais ,je dois l'avouer,c' est une matière difficile,exigeante.
j'avais heureusement eu l'idée de m'avancer l'année dernière
Je travaille actuellement sur la décision Quintin de 1991 du Conseil d'Etat,et j'hésite sur le plan a suivre
En effet,cet arrêt traite en premier lieu de la théorie de la loi transparente (il reprend,en ce sens,la décision ""Scté internationale Sales and Import Corporation du 13.12.1985 du même Conseil d'Etat) ,théorie qui permet de contourner la "théorie de la loi-écran" inaugurée par l'arrêt Arrighi 1936.
Toutefois,dans ce même arret quintin,le requérant demandant au Conseil d'Etat de saisir la CEDH,la haute juridiction administrative lui répond que cela n'est pas de sa compétence....
Si l'arret n'évoquait pas ce dernier point,j'aurai donc centré mon commentaire d'arret autour du contournement de la théorie de la loi-écran,mais ce point concernant la CEDH brouille mon plan......
J'hésite donc sur ce qu'il faut faire,et j'ai un peu de mal apour les commentaires d'arret en Droit adminstratif,si vous pouviez me donner quelques conseils, je vous en serai infiniment reconnaissant

Juste une petite précision...
Dans votre cas, cela revient peut-être au même mais en général, un site peut être "invisible" dans une recherche sur moteur de recherche (type yahoo chine) sans être censuré. C'est une question de référencement.
Ceci dit, je comprends les chinois car ce site est totalement subversif!!!
Les avocats sont de dangereux activistes de la liberté d'expression.

Aujourd'hui votre site est accessible de Chine.
Le réseau Internet chinois n'est en fait pas un Internet, mais un Intranet, comme à l'intérieur d'une entreprise. tous les points d'accès et les DNS sont controlés, donc ils peuvent filtrer avec un système de type "proxy" comme en entreprise.
En réalité, ce n'est sans doute pas seulement votre site qui est visé, mais un site de blogspirit, ils bloquent donc le tout d'un coup. Il n'affine pas la censure à ce point :o)
Ce ne sont donc sans doute pas vos articles écrits en Français qui sont en cause. Par exemple, aujourd'hui de chine on peut accèder à la page de wikipedia en francais sur tian an men, mais pas à celle en chinois...

La Chine c'est la chine. Sans vouloir être méchant ni vulgaire ils font c*** tout le monde et ils n'en ont pas finis avec la mondialisation. Les rapports diplomatiques qu'ils entretiennent sont "mauvais", il serait temps qu'ils s'ouvrent au monde et non pas le monde qui s'ouvre à eux. Et nous, tels des lèches-bottes, nous n'avons pas d'autre choix que du subir. Subir car nous ne pouvons négliger cette puissance ne serait-ce qu'économiquement.
