Grands arrêts illustrés : l'arrêt Septfonds
Puisque l’actualité (voir ici), nous y invite, essayons donc de trouver, pour ranger dans notre album des grands arrêts illustrés de la jurisprudence administrative, une image de l’arrêt Septfonds.
Seulement voilà. Vous rappelez vous l’espèce qui mena au prononcé de cette décision ? Un air entendu, cher ami, voyons, pour qui me prenez vous ; un air dubitatif, euh, monsieur, on ne l’a pas étudié en première année ; pas d’air du tout : qu’est ce que c’est que cette histoire d’arrêts de Septfonds, et d’album (ça c’est pour la personne qui s’est retrouvée sur ces pages après avoir tapé « meccano » dans google, et qui a dû chercher bien longtemps les relations entre nos préoccupations et son jeu de construction préféré. Je lui cependant souhaite la bienvenue, et laisse à quelque normativiste de passage le soin de lui apporter toute précision utile).
Or, donc, l’arrêt Septfonds concernait un litige s'étant élevé entre le sieur Septfonds et la compagnie de Chemins de fer du Midi. Il s’avère que ledit sieur Septfonds (à force de le nommer l’orthographe de son nom qui risque de subir une multiplication par deux) avait confié à ladite compagnie 43 sacs de sucre, en gare de Toulouse, à charge pour elle de les convoyer jusqu’à Espalion.
Incidente : Espalion, riante citée de l’Aveyron, dont je ne saurais trop recommander les chapiteaux historiés et le tympan de l’église, qui sont un chef d’œuvre de l’art roman, au demeurant fortement inspirés de sculptures de Conques).
Or voilà que lesdits sacs de sucre ne rejoinrent jamais leur destination finale. Et ce fut, vous vous en doutez, la source du litige entre notre particulier, et notre compagnie. (Notons que l’expédition eu lieu en février 1918, et qu’il est vraisemblable qu’en cette période de troubles, hivernale de surcroît, cette quantité de sucre ne fut sans doute pas perdue pour tout le monde mais peu importe, d’un point de vue pénal la prescription semble acquise).
Illustrer donc ce litige, est donc mal aisé : comment trouver l’endroit précis où s’égarèrent les sacs de sucre ? C’est une entreprise au delà des forces du blogueur qui n’aura guère de témoignages de première main à se mettre sous la dent.
Faute de localisation précise, me murmuré-je à moi-même à force de consultations multiples de google image, trouvons au moins une image de cette ligne de chemin de fer, et laissons à nos imaginatifs lecteurs le soin de se figurer la scène, dans les tons chromos du supplément illustré du Petit-Journal (comme celui-ci, encore qu’ici le sucre volé risque d’être retrouvé sous la forme de caramel)..
Mais, hélas un examen attentif de ces photographies (celle-ci aussi) révèle, sans doute aucun, qu’un nouveau larcin a été commis : ce ne sont plus seulement les sacs de sucre qui ont été volés, mais la ligne de chemin de fer elle-même…
Et comble d’infortune, aucun arrêt, ni grand ni petit, n’est vu sanctionner ce nouveau larcin…
