CEDH 31 janvier 2006 GINIEWSKI c. France, où l'on reparle des relations entre liberté d'expression et croyances religieuses
L’arrêt GINIEWSKI c. France rendu par la CEDH le 31 janvier 2006 apporte, comme cela a été souligné par CM, dans le commentaire de la note précédente, un éclairage intéressant, et particulièrement actuel, dans les débats sur les relations entre la liberté d’expression et la protection des opinions religieuses.
Cet arrêt qui ne semble pas avoir de prime abord une portée doctrinale essentielle, permet néanmoins de préciser ou de conforter plusieurs points qui pouvaient paraître fluctuants dans les décisions antérieures.
Tout d’abord, est bien rappelé le « jeu » de la marge manœuvre nationale en matière de liberté d’expression. En clair, la marge de manœuvre s’exerce sur le point de savoir si l’ingérence dans la liberté d’expression est bien « nécessaire » dans une société démocratique, et le seuil de cette nécessité varie selon la nature des objets auxquels s’adresse la liberté d’expression : les objets religieux (ou moraux) méritent une considération particulière, ce qui justifie des ingérences accrues dans la liberté d’expression, et de surcroît, compte tenu de l’absence de standards européens, la marge de manœuvre nationale se trouve accrue « même si elle n’est pas illimitée ».
Ensuite, la Cour rappelle une distinction existant dans sa jurisprudence antérieure entre les contestations « gratuites et offensantes » d’opinions religieuses, et celles qui participent à un débat d’intérêt général : « dans le contexte des opinions et croyances religieuses – peut légitimement être comprise une obligation d’éviter des expressions qui sont gratuitement offensantes pour autrui et constituent donc une atteinte à ses droits et qui, dès lors, ne contribuent à aucune forme de débat public capable de favoriser le progrès dans les affaires du genre humain » (§ 43 de l’arrêt).
Cette distinction conduit, dans l’affaire Giniewski, la Cour à estimer qu’une accusation, plus ou moins voilée, selon laquelle l’Eglise catholique aurait une part de responsabilité dans la Shoah ne peut pas encourir le délit de diffamation (et donc une ingérence dans la liberté d’expression) dès lors qu’elle résulte d’une analyse d’intérêt général des effets des doctrines de l’Eglise sur les relations entre les chrétiens et les juifs.
En revanche, la Cour souligne, en le citant d’ailleurs expressément, que dans l’arrêt I.A. l’attaque était « gratuite » et que dès lors elle ne peut bénéficier de la même protection.
Ce critère du sérieux du débat contre la gratuité de l’attaque mérite d’être entendu. Il nous semble effectivement que la thématique de la responsabilité n’est pas, en matière de liberté d’expression, irrecevable. Je dirais même, ben au contraire, c’est précisément en maintenant une responsabilité individuelle qu’on maintiendra une liberté également pleinement individuelle.
Il reste cependant que l’arrêt Giniewski s’inscrit dans un courant qui demeure inquiétant. La meilleure preuve, c’est qu’il fait de l’arrêt I.A. un des points d’appui du raisonnement alors que celui-ci avait été rendu à une seule voix de majorité (donc celle du juge national) et avait fait l’objet d’une forte opinion dissidente sous l’influence de Jean-paul Costa. Et l’un des motifs d’inquiétude tient à ce que la notion d’attaque « gratuite » vise des catégories d’expressions très diverses dont l’expression artistique. D’ailleurs, dans l’affaire I.A. c’est bien une œuvre littéraire qui était contestée et dans nos débats actuels, les dessins, quoique de presse, n’en demeurent pas moins des œuvres de création.
Autrement dit, il y aurait de fortes chances que la jurisprudence I.A puisse être étendue à toutes les expressions artistiques (et l’on songe notamment aux œuvres de cinéma qui sont en première ligne) qui ne bénéficieraient pas du label « débat d’intérêt général ».
Ce dernier arrêt rendu par la Cour ne dissipe donc pas l’inquiétude, bien au contraire sur les restrictions subies par la liberté d’expression dans le droit de la Convention.

A la lecture de la décision Giniewski que vous avez commentée, j'ai le même sentiment que vous, à savoir que la cour fait clairement une distinction entre le débat "utile", celui qui s'inscrit dans une discussion légitime ou d'intérêt général et le débat qui n'est pas sérieux ou qui est "gratuit" et qui, en conséquence, ne bénéficie pas de la même protection.
N'étant pas un fin connaisseur de la jurisprudence de la cour, je me pose la question de savoir si cette distinction, qui me paraît par essence hautement subjective (donc hautement criticable) est appliquée à l'ensenmble des ingérences à la liberté d'expression ou seulement à celles qui s'appliquent pour la protection des croyants. En effet, au point 28 de la décision il est indiqué que "le requérant conteste ensuite l’affirmation selon laquelle, sous prétexte que l’article litigieux porte sur une question sensible d’ordre religieux, sa liberté d’expression peut être plus étroitement encadrée" sans véritablement qu'il soit apporté de réponse.
Il semble bien qu'il existe une différence dans l'appréciation de la cour, dès lors qu'au point 44 il est indiqué que l"a Cour a maintes fois déclaré que les Etats contractants jouissent d’une marge d’appréciation certaine mais pas illimitée (Wingrove, précité, § 53). Le manque d’une conception uniforme, parmi les pays européens, des exigences afférentes à la protection des droits d’autrui s’agissant des attaques contre des convictions religieuses, élargit la marge d’appréciation des Etats contractants, lorsqu’ils réglementent la liberté d’expression dans des domaines susceptibles d’offenser des convictions personnelles intimes relevant de la morale ou de la religion". Il semble bien que la cour, dans le domaine des convictions morales et religieuses accepte que la liberté d'expression soit encadrée de façon plus étroite. Si tel est le cas, alors, peut-on dire que les convictions religieuses et morales sont plus érieuses pour être ainsi plus protégées et justifier un encadrement plus étroit ?
Autre chose, au point 48 la cour affirme qu'elle ne saurait sousrire au reproche fait au demandeur selon lequel sa thèse incriminerait l'ensemble des chrétiens qui seraient responsables des massacres nazis. Pour ce faire elle "observe d’abord que l’action en diffamation intentée contre le requérant a été formée par une association, l’« Alliance générale contre le racisme et pour le respect de l’identité française et chrétienne ». Il n’appartient pas à la Cour de se prononcer sur la représentativité de ce groupement, ni sur sa vocation à défendre l’Eglise catholique ou la chrétienté en général. Ce n’est pas non plus le rôle de la Cour, qui se substituerait aux juridictions nationales, d’apprécier si l’article en cause portait directement atteinte à l’association plaignante ou aux intérêts qu’elle entend défendre."
Pourquoi avoir mentionné ce problème alors si elle n'a pas à juger de la représentativité de l'association ?? cela ressemble vraiment à de la dénégation. On peut se demander tout de même si une plainte déposée par les autorités officielles de l'Eglise aurait connu le même sort... ce qui est, encore une fois, criticable...

Il faut savoir que la CEDH ne reconnaît pas d'intérêt à agir aux associations, et qu'elle ne les considère pas comme victimes. Ce n'est que lorsqu'on peut considérer que la personne physique auteur de la requête peut être considérée comme représentant des personnes physiques considérées comme victimes que la requête peut être recevable. Et dans cette optique, l'action d'un "leader" religieux au nom des fidèles est admise mais pas celle d'un président d'association ou de syndicat. Le parti pris est discutable, mais il n'est pas dépourvu de fondement, dans la mesure où dans le cas des associations et syndicat agissant en excès de pouvoir le litige porte toujours sur des matières "publiques", et en tout cas jamais (ou presque, car il y a un cas intéressant concernant mon syndicat, mais ce n'est pas le lieu pour en parler) sur des matières concernant la vie du groupe en tant que tel, sa vie interne. Alors que pour le culte, les actes incriminés constituent des actions externes (et privées) ayant pour objet la vie interne de la communauté, ou du moins des droits et intérêts qui lui sont propres.
La CEDH ne prend donc pas en considération les droits et intérêts d'une association pour la défense de l'intérêt collectif, elle ne les prend en considération que sur le fondement des articles 8, 9 ou 10 de la Convention.
Par ailleurs, le PIDCP pourrait par son article 19 protéger davantage que l'article 10 de la Convention, mais la France l'a assorti d'une réserve, déclarant "que les articles 19, 21 et 22 du Pacte seront appliqués conformément aux articles 10, 11 et 16 de la Convention
européenne de sauvegarde des droits de l’homme et des libertés fondamentales en date du 4 novembre 1950".
Or cet article 19 du Pacte dispose que:
"1. Nul ne peut être inquiété pour ses opinions [ajout % Convention]
2. Toute personne a droit à la liberté d’expression; ce droit comprend la liberté de rechercher, de recevoir et de répandre [plus large que la Convention] des informations et des idées de toute espèce, sans considération de frontières, sous une forme orale, écrite, imprimée ou artistique, ou par tout autre moyen de son choix [plus large encore].
3. L’exercice des libertés prévues au paragraphe 2 du présent article comporte des devoirs spéciaux et des responsabilités spéciales. Il peut en conséquence être soumis à certaines restrictions qui doivent toutefois être expressément fixées par la loi et qui sont nécessaires:
a) Au respect [la convention parle de protection] des droits ou de la réputation d’autrui;
b) A la sauvegarde de la sécurité nationale, de l’ordre public, de la santé ou de la moralité publiques".
Enfin, je veux terminer par une considération "topologique", déjà très familière aux spécialistes de ppté intellectuelle :à lire le texte de la convention, et la jurisprudence de la CEDH, il semble bien que ce qui limite le volume de la liberté d'expression, son espace, ce sont certaines sphères "protégées". On peut discuter du volume desdites sphères et du degré de protection dont elles doivent jouir, mais si on leur reconnaît une protection, il faut bien que celle-ci soit effective sans quoi ce ne serait, comme notre "séparation des pouvoirs" nationale, qu'une déclaration, que la proclamation d'un idéal à atteindre. Dès lors, la question me semble bien plus politique que juridique, et la marge en cause, c'est celle du politique % droit (pour pouvoir limiter la liberté d'expression ou, en vérité, pour en "protéger" certaines sphères), et du droit % politique (pour pouvoir donner un minimum de portée et d'effectivité à une disposition figurant dans un texte de droit).
Sur cette dernière question, j'ai pu encore récemment constater l'extrême réticence de bon nombre de juristes français au principe d'effet direct au bénéfice des particuliers des droits inscrits dans les traités. On aura compris que je suis pour l'effet direct et pour l'invocabilité, c'est à dire pour la juridicité.

En effet il est toujours delicat de faire la distinction entre la liberte d'expression et l'opinion religieuse, c'est un peu comme on dit "La liberté des uns s'arrête là où commence celle des autres". Dasn un pays de droit, il est important de bien garder les limites et qui plus est, quand on vit dans un pays laique comme le notre.
